The Victory Over the Collectors in the Highest Court of Ukraine

Today team of the Law Firm "Moskalenko & Partners" namely the partners Berdan Igor, Moskalenko Anastasiya and lawyer Moskalenko Darina won the dispute of our client with the collector company "KREDEKS Finance" about recovery of 144 000 UAH debt under the credit agreement in the Highest court of Ukraine on civil and criminal cases. Our appeal had been substantiated with failure to apply the statute of limitations on the priority of payments and the lack of detailed calculation of debt, the refusal to appoint judicial economic expertise of the debt under credit agreement, violation of the civil process, competition and equality of the parties and other violations which made it impossible to fully find out circumstances of the case in the courts of 1 and 2 instance. The Court decided to fully satisfy our complaint, to cancel illegal and unjustified decisions of the lower courts and remand the case for retrial.
