New Rules for Citizens’ Associations

The new Law "On Public Associations" radically changed the legal and organizational basis for the functioning of public organizations in Ukraine. These changes are analyzed in his article of May 29, 2012 "The New Rules of the Freedom of Association of Citizens," by Anastasiya Moskalenko and Elina Antsut, published by the leading Ukrainian legal portal "Jurliga".
The authors draw attention to the fact that the new law expanded the rights of public associations and detailed them, as well as the fact that the law already entered into force on the 19th of April, 2012, but shall be enacted on the 1st of January, 2013. At the same time will lose the legal force the Law of Ukraine "On Associations of Citizens". The new law radically changed legal and organizational basis for creation, operation and termination of public associations.
The new law applies the terms and definitions which differ from those contained in the Law of Ukraine "On Associations of Citizens" as of 16.06.1992, the general concept with respect to associations created to meet social needs without purpose of profit, are now "public association". Public Association - a voluntary association of individuals and / or legal persons of private law for the exercise and protection of the rights and freedoms, to meet the public, in particular economic, social, cultural, environmental and other interests. Public association of the legal form is formed as a public institution or public alliance.
Non-governmental organization - is a public association, the founders and members of which are natural persons. Public union - is a public association, founded by legal persons of private law, which members can be both legal persons of private law and natural persons.
After reviewing and analyzing the Law of Ukraine "On Public Associations" the authors concluded that it "pushed the ice" in the plane of the post-Soviet legal regulation of citizens' associations and, despite some shortcomings, substantially improved legislation in this area, making the realization of the constitutional right to freedom of association more accessible, comfortable and versatile.
