Our Team Defended Client from the Unlawful Confiscation of Money

Due to the high professional skills and application of practice of the European Court of Human Rights the team of the Law Firm "Moskalenko & Partners" protected in an administrative case on violation of the Art. 471 of the Customs Code of Ukraine, the client who carried without declaring (but not hiding) funds in foreign currency that exceed the amount permitted to move across the customs border of Ukraine without declaring (i.e. who transported without declaring cash in the amount of more than EUR 10,000).
For this violation of customs control passing in zones (corridors) of the simplified customs control the first instance court sentenced the client for a fine and confiscation of funds in an amount exceeding the equivalent of EUR 10,000 in accordance with the Art. 471 of the Customs Code of Ukraine.
In the Court of Appeal the client's interests were represented by the attorney, partner of the Law Firm "Moskalenko & Partners" Anastasiya Moskalenko. After saturated debate of the attorney with the prosecutor and the customs' representative, the court decided to return illegally confiscated funds to our client. Appellate court decision is final and non-appealable.
